Tsegaye examines how Africa is undergoing a fundamental shift in the composition, pricing and legal structure of capital, where private capital is playing an increasingly significant role. He considers that while sovereign bond disputes will continue to be resolved primarily through the courts, arbitration’s opportunity is in supporting project finance, public-private partnerships and other sovereign-adjacent structures through which private capital is deployed.
