It highlights cases which reflect the key issues facing the legal industry internationally today.
Signature's Privinvest Shipbuilding SAL (Holding) and others v Filipe Nyusi appeal case is being heard this week. Privinvest’s appeal concerns the question of whether President Nyusi of Mozambique is entitled to assert sovereign immunity to challenge the jurisdiction of the Courts of England and Wales, which the Commercial Court found at first instance he was. The Court of Appeal will also consider if President Nyusi was validly served with proceedings in 2021 and so was out of time to contest jurisdiction in 2023.
An appeal to the Supreme Court in Recovery Partners and Revoker v Irakli Rukhdze and others, the date of which is yet to be confirmed. Signature act for the Appellants, whose appeal concerns an often litigated issue in law relating to breach of fiduciary duties and in particular the correct rule to be applied when assessing the scope of a defaulting fiduciary’s liability to account for profits.
