FIND OUT MOREPartner Abdulali Jiwaji comments in Law360 in relation to a recent FCA test case in R (CIT) v FCA [2025] EWHC 2614 (Admin), which provided clarity on the FCA’s powers to name firms under investigation. The Court upheld the FCA’s decision to publicise its investigation into the firm, reaffirming the legitimacy of the FCA’s “exceptional circumstances” test, rejecting arguments that the regulator had misapplied its Enforcement Guide. Abdulali’s comment was published in Law360 7 November 2025, here.
Law360 notes the FCA gave 24 hours’ notice of announcement in the case reviewed and the court provided the company permission for a judicial review, considering the substance at the same hearing. The article also notes that to challenge a decision by the FCA to ‘name and shame’ in exceptional circumstances, the company must move quickly to apply for a court order preventing a regulatory announcement before the outcome of that challenge.
Abdulali commented: “Some firms will not have the resources to raise a challenge in time”.
